By accessing, purchasing, installing, or using any component of FomoToolkit ("the Software"), you (“the User”) hereby agree to be unconditionally bound by the following Terms and Conditions. Please read them carefully before proceeding.

FomoToolkit™ is a display utility that outputs frontend "social proof" style notifications based on inputted data via user-managed sources. The User maintains full responsibility for the content, language, timing, targeting, and appearance of all popups deployed on their or their clients’ websites. FomoToolkit™ does not provide or verify the accuracy, legality, or source of any data displayed. Any messages, names, locations, or purchase claims shown using FomoToolkit™ are entirely user-generated. Any sample data or content provided by FomoToolkit™ is offered solely for demonstration purposes, and how it is used, adapted, or displayed remains entirely at the discretion and responsibility of the User. It is the sole responsibility of the User to ensure that their implementation of the tool complies with any applicable legal, advertising, consumer protection, or privacy laws in their jurisdiction or that of their audience.

FomoToolkit™ and its creators, affiliates, partners, or distributors accept no liability for any misuse, misleading representation, legal disputes, performance loss, or reputational damage that may result from how the User chooses to configure, customize, or deploy the Software. The Software is sold “as-is” without warranties or guarantees of any kind - including but not limited to fitness for a particular purpose, uptime, compatibility, or increase in conversions, ROAS, or engagement.

By purchasing, installing, or using FomoToolkit™, the User expressly agrees to waive, release, and forever discharge FomoToolkit™ and all associated parties from any and all present or future claims, demands, liabilities, losses, or legal actions arising from the use, misuse, or outcomes associated with the Software.

All components of FomoToolkit™ - including but not limited to the brand name, scripts, popup designs, template files, original visual assets, CSS frameworks, interface behavior, and deployment code - remain the sole intellectual property of FomoToolkit™. Unauthorized copying, reverse engineering, sublicensing, or redistribution of any core assets or proprietary logic is strictly prohibited.

Purchase/sign-up of a FomoToolkit™ license includes lifetime access to the core product and any future updates to its included templates or core functionality. While we aim to maintain compatibility across major website platforms and deployment environments, FomoToolkit™ offers no guarantees for third-party platform updates or browser-based limitations. The User is responsible for monitoring their own usage limits. Basic implementation support is included via the provided contact form or documentation. FomoToolkit™ is not obligated to provide in-depth custom development or ongoing consulting unless under a separate agreement.

The Software may not be used for fraudulent purposes, to impersonate individuals, or to deceive customers with fabricated information in a manner that violates advertising laws or other relevant regulations. The User assumes all responsibility for ensuring their usage aligns with acceptable marketing and ethical standards.

All prices are listed in USD unless otherwise stated. Payments are processed securely through third-party providers (e.g. Stripe), and we do not store or have access to full credit card information.

All payments must be made in full at the time of purchase. Access is granted immediately upon payment confirmation, and access to the course content is granted right away. We currently do not offer installment plans or deferred payment options. Please ensure your payment method is accurate and authorized prior to completing your order.

FomoToolkit™ reserves the right to restrict access to updates, support, or future integrations for users who violate these Terms or engage in abuse of the Software, intellectual property, or brand.
